Contract - 6 months

The Role:

MBNL's Legal Property Team provides commercially focused and efficient legal solutions together with risk management support across all areas of the business. The team are responsible for a range of activities including delivering robust and legally sound contracts; dispute resolution and management; and supporting the wider Property & Legal function on all aspects of property acquisition, disposal, and estate management.

The Legal Counsel (Property Litigation) involves legal management of a significant portfolio of sites in litigation, covering all projects and "business as usual" areas including Code renewals; Notices to Quit - exits and replacement sites; Site Access & Estate management (including rent review, dilapidations, decoms etc).

What the Legal Counsel (Property Litigation) will do:

  • Strategically and/or estate-significant disputes work (acting as a point of escalation from early-stage disputes handled by the regional team lawyers).
  • Regulatory advisory work including general health and safety, fire safety, building safety, ICNIRP, competition law; and
  • Public law matters as required (primarily concerning planning matters and judicial review).

Broader responsibilities may require the holder of the role to act as the Lead on the following matters:

  • Telecoms judicial reviews.
  • Noise abatement notices.
  • All magistrate's court enforcement procedures.
  • All aspects of site access).
  • Underpaid/overpaid rent.
  • Rent arbitrations.

The successful Legal Counsel (Property Litigation) will have:

  • A UK/Dual Qualified solicitor
  • 3 years PQE (or equivalent)
  • Experience of Real Estate Litigation.
  • Ideally some in-house experience but will consider candidates from a private practice.
  • Ability to handle large workloads and to adapt and learn new skills.
  • Excellent communication, Drafting and Negotiating skills.
  • Ability to work well and thrive under pressure.
  • An ability to work in a rapidly changing environment with complex and occasionally challenging relationships.
